Bundaberg Applicable Event
The Deputy Premier Jarrod Bleijie MP has declared the Bundaberg rain and flood event an “applicable event” for purposes of the Planning Act 2016.
This applicable event will be in place from 12 March 2026 to 7 April 2026, and provides for the following –
Declaration of Uses and Temporary Use Licences
The declaration provides for shops and other uses directly necessary for the supply of goods to shops, to be declared uses for the applicable event. This means that businesses such as supermarkets, service stations, warehouses and transport depots, can operate 24/7 to ensure essential goods are available to the Bundaberg community.
The declaration also enlivens the temporary use licence (TUL) provisions of the Act, whereby businesses can apply to the Chief Executive of the Department of State Development, Infrastructure and Planning (DSDIP) to change or vary conditions or operating constraints that may prevent them from operating during the applicable event.
Extension of Development Assessment Periods
The declaration has also extended key development assessment timeframes by 17 business days across the Bundaberg Regional Council Local Government Area (LGA). Notwithstanding these extended timeframes, Council’s development assessment team is still committed to undertake the assessment of applications in a timely manner.
