Indigenous Land Use Agreement

As defined on the National Native Title Tribunal website, an Indigenous Land Use Agreement (ILUA) is a voluntary agreement between a native title group and others about the use of land and waters. These agreements allow people to negotiate flexible, pragmatic agreements to suit their particular circumstances.

Council has been involved in negotiations to establish an ILUA with the Port Curtis Coral Coast (PCCC) people. The ILUA covers a large part of our Regional Council area and parts of the North Burnett and Gladstone Regional Council areas.

The ILUA has been signed by all parties and was registered on May 3rd, 2018. A formal signing/acknowledgement ceremony of the ILUA was held on November 29th, 2016.

The ILUA document comprises five parts:

  • Part 1 Preliminary relates to technical and preliminary issues including definition, parties to the agreement and other technical points.
  • Parts 2, 3 and 4 of the ILUA essentially set out in a clear format the legislative requirements on both Council and the PCCC regarding resolving the Native Title claim and Native Title and Aboriginal Cultural Heritage compliance.
  • Part 5 of the ILUA does place further obligations on Council. In particular it sets out requirements regarding place and road names, publications, local events, cultural awareness training, funding programs, tender policy and the establishment and ongoing role in a consultative committee.
